Thank you for contacting me regarding S. 729, the "Development, Relief, and Education for Alien Minors (DREAM) Act." It is good to hear from you.
S. 729 was introduced on March 26, 2009, and referred to the Senate Judiciary Committee. After meeting certain criteria, illegal aliens would be allowed to receive in-state tuition from the state in which they reside.
The legislative language establishes these requirements for an individual to qualify for the tuition benefit:
o must be under the age of 35,
o have entered the United States before the age of 16,
o resided in the United States for at least the last five years
o earned a high school diploma or GED in the United States

There were so many rejected L1 Individual petitions filed by TCS/Infy/Wipro etc.. These big companies will include all the internal tools in the resumes and INS asked for the purchase orders for all the specialised tools.
As there were no PO's for those tools, petitions were rejected in large numbers. This has started in the last year and continuing... i personally have lot of friends whose petitions were rejected and went back to India..
I also know a few people from these companies. Remember when the senators/congressmen sent the letters asking for explanation of how they are using h-1/l-1. Companies responded with the biggest bull---- answers.
Now they are seeing what happens when you don't take serious when government representatives ask you things. Unfortunately; they are being picked on but everyone else is becoming collateral damage.

Got a CRIS Notification for EAD Card PRODUCTION dated Sept 2nd for my wife.
EAD receipt Dat: July 23rd
Card Production date: Sept 2nd
They say it will take 30days to get in the mail..
No idea whether it really takes 30 days or less so I can verify actual validity of the EAD card !

What I am saying is all should stand in line purely based on priority date, no matter whether he is Chinese, Indian, Japanese, or Nigerian. We would all like to part of a rally or protest but why give us only one days notice? Surely most people will not have read this post by tomorrow. We should organize this properly by sending out the message to the community well in advance and getting the required permits (I mean if you want this to be in any way successful that is).

Dear mpkmaster, it is easy to ignore facts and throw stones like "your are rasist". And it is not easy to face the reality. Since you are so smart, I would like to ask you some questions:
1. Why there are long immigration lines in the US, Europe, Australia, Canada, Singapore etc, and almost none for Mexico, Latin America, Middle East etc. Maybe because these countries a full of "racists" ?
2. Tell me why some some people/countries can manage their economy and become attractive centers for immigration and other are just hell holes. There is a huge difference between Japan, S. Korea, China and N. Korea and they are populated by the same race - what has racism has to do with that ?
3. Why did you immigrate from your own country?
I will tell you one thing - due to my profession I have visited most countries in the world, including India. And definitely have a better understanding what is racism, what is protectionism, what is laziness, stupidity etc. Do not hide all these behind "racism", won't work...

We'll do these things for common/generic issues like visa recapture,not counting dependents visas,removing per country quota.

Everybody has been waiting for his/her green card and congratulations to all those who has got their GC. On the other hand it is really unfair and to some extent unethical on the part of USICS not follow a fair system.
There are several people in 2004, 2005 who have been paitently waiting for their turn only to see that people behind them getting approved.
You are talking about 2004, 05. What about 2001, 2002 and 2003? There are so many people with 2002 priority dates still waiting just like me. Mine is 02/2002

Folks, it is time for the H1B community to grow up. Business is business. I am not a blood sucking deshi firm, or a silent partner. On the contrary, I happen to be a trained mediator, published author on conflict management and professional in strategy/organizations. My view is pretty simple: mathematical 'tit for tat' doesnt take you far. Build, nourish and manage relationships. Money and math are secondary. Its time to grow up.

hope that means they are willing to talk about giving EAD. If we get EAD all the lawsuits will be withdrawn. The law does not say AOS applications should not be accepted when there are no visa numbers available, the law only says AOS cannot be approved when visa numbers are not available. USCIS internal regulations says they will not accept AOS applications when priority date is not current. by now its quite apparent that USCIS has broken a lot of there own internal regulations just to make sure the visa numbers are used up before july 2 2007. Then can easily accomodate the EAD for july filers. It all depends upon the pressure exerted on USCIS and DOS

Could you please show us, where in the link you provided, H-1B applicant needs to treated equally for job hiring as compared to GC and EAD workers.
EOE deals with equality (i.e. equal opportunities) for hiring, job promotion, and firing.
IRC Act 1985 deals with unlawful employment of aliens, unfair immigration-related employment practices, and fraud & misuse of certain immigration-related documents.
Two different things.
However, once H-1B applicant is hired, he/she is protected just like any other worker, for job promotions, training, and other work conditions. But employer is under no obligation to extend H-1B beyond any initial H-1B petition date. And, yes, H-1B can also be fired at will*, just like any other worker.

"(1) GENERAL RULE. -- It is an unfair immigration-related employment practice for a person or other entity to discriminate against any individual (other than an unauthorized alien) with respect to the hiring, or recruitment or referral for a fee, of the individual for employment or the discharging of the individual from employment --
The only individual that can be discriminated against is an unauthorized alien. H1B/GC/EAD/Citizen does not fall in this category.
Walking dude's effort will at least highlight the fact that H1Bs are not preferred over GCs/Citizens. In fact it is the other way around. One of my colleague who recently got his GC, was surprised to see so many job offers opening up for him just because he was a GC hoder.

Got receipt notice for I-485/AP/EAD/ from USCIS today (8/30/2007). My package was delivered to Nebraska center on July/27/2007. Notice date is August 21st, 2007. My priority date is Dec/23rd/2003.
