    Attorney received all our Receipt Notices today from CSC. Our packet was reached NSC on 7/27. NSC sent the packet to CSC. CSC transferred our I-485 back to NSC on 9/26 as my I-140 was approved from NSC.

    CFR22 is not the law. INA is the law. I could not find it in INA, that is all we need.

    Honestly, I dont care if they are eligible for FB2A.
    All I care is eb-dependents are not eligible for EBquota.

    why are you quoting and supporting the official mis interpretation above the actual law ?



    Is it still not clear for you? eb-dependents are NOT eligible for F2A.
    So we have to follow the regulation and the regulation (CFR22) mentioned specifically that eb-dependents are eligble for EB-category. Regulations and interpretations are there for a reason, and it has to be followed when law is not clear.

    I agree that INA doesnt specifically says that, but at the same time INA specifically rules out eb-dependents from F2A also. To be eligible for F2A you should be dependent of a permanent resident "at the time of application".

    You should probably stream line your effort to not count eb-dependents in any visa-numbers (since neither the regulation or law is clear on that part).

    You are still under a mis-concept that every word and sentence has to be quoted in "INA", and can ignore all official regulations and interpretations.

    Guys,

    as long as there is a leeway, people do tend to take the maximum advantage of that leeway. this applies in life in every aspect. OP did the same.

    being moral or ethical is not the criterion here I guess, otherwise we would all have (I,C) have been current ( if no labor subs, eb3 to eb2 conversions etc).

    I feel bad too, seeing some one who landed on H1B in 2006 , got hold of a 2002 labor sub. and is enjoying GC right now(thanks to July 2007 fiasco)., and for crying out loud I have been in USA since 2001, went to school here, is working in a physical science research position, have one patent and filed for 2 more.

    I consider myself to have contributed to the USA, more than the guy I gave an example of (in terms of taxes, tuition, original research, etc). But does that all matter to the other guy, when he did what he did.

    Abuse can happen as long as there are desi consulting companies. Major companies in silicon valley does not file for an EB2 unless salary is > 95k and unless they advertise M.S. + 2 years. How many desi consulting company jobs are really EB2 jobs? Think about it.

    The latest trend is, leave current job where they filed an EB3. Go to desi consulting company, file for EB2 with old priority date. Get GC. Come back to old company with hike and of-course GC.





    Equating labor substitution with porting is real silly. Labor substitution was clamped down, because of abuse, however it didn't mean that it was wrong by its very virtue. However the abuse lead to its closure.

    As for porting, I don't see any scope for abuse. Cuz the process is in such a way, that one has to refile labor, 140, and all the exact procedures similar any freshly new EB-2 candidate would. The only difference is that at the end, one has option to request his/her earlier date.

    And rightly so, because there's a difference between two Eb-2 filers. One who has not filed anything before, and one has filed "SOMETHING" before. That "something" holds the merit.

    These words are not trivial. I have personally witnessed and believe an immense power hidden in these words. I with everybody else in this forum really, really want the miracle to happen with you that cures you completely and brings you back to your normal life.

    This is my first post in this forum. Until today I was a bystander on the fence never actually got inspired enough to fight for a cause as trivial as getting a green card. But today I broke the fence and came in. Because never before in my life I have seen such a real courage in a real person. I salute you and wish I can be as courageous as you when life will demand from me.

    Just want to let you know that somebody somewhere dropped a few tears for you and will continue to pray to the power above for your speedy recovery and well being.

    Any suggestions?

    Working on EAD for a short time, even in a different occupation, with 1099 is not an issue. However, this will not satisfy the requirement for 485 approval. You must have a valid fulltime, permanant job offer in the same or related occupation at the time of 485 approval as well as when they issue a RFE regarding your employment.

    I would request IV core team to concentrate on new bill or some way for relief to skilledworkers like us. I dont think waiting until end of July is good option here. It is certain that CIR is not going to be there for this year..whole US world is thinking of same.

    Further request to IV core team to work on some thing different for relief for skilled workers

    Applied for EAD on 24 July 2008, recd today. Valid for 2 years from the date of approval. Though lost almost 2 months on the previous EAD.

    My applications ( I-140; I-485; I-765) were mailed on July 27th to NSC and they had acknowledged received on JULY-30th as per the mail delivery confirmation.

    Today I recieved a note from my lawyer that the receipt notice has been issued for all of my applications.

    Phew that was a relief as I was about to leave to India soon and was worried about travelling without the receipt number.

    That is probably the most absurd thing said in this forum.

    Purgan, please do some basic research and you will see you are plain wrong. There is no way you will see your dream coming true. Govenment intervention when it comes to regulate the influx of foreign labor is everywhere. It is controlled. You just allow less or more people coming in and that is fair. If you allow the gates of a third world country to open for good and flood this with programmers to a point where you would be making $10/hour, nobody sane wants to get downgraded to that level. Foreigners with a funny accent like us would be competing for jobs. Probably employers would love and exploited people in the third world countries would love that, but I have to tell you things don't work that way.

    Similar polls were conducted by Zogby, CNN, etc. I outlined other evidences there. Only individuals with an open mind can read between the lines though.


    when american's from such third rate schools are not getting jobs, do you seriously think foreigners with their funny accents and relatively poor English communication skills (I'm Indian and can tell you its still a second language to me) can get jobs??

    The market has a way of regulating itself. As someone mentioned above, there were a a lot of H1 space available from 2001-03. But it never got filled because there were simply not enough jobs. Lets not try to set up govenment intervention here....let the free market decide....that is what made this country great.

    btw, NumbersuSA, FAIR and other restrictionist organizations have zero credibility because they oppose even legal immigration.

I was researching some stuff & since you are from Fiji & with the political unrest in your home country, can you take political asylum since you were kinda forced to leave the country.
